Debbie asks: I want to know what we should do when we have approached the bank for help and we don’t seem to be getting any help?
Dominique Grubisa: It depends what your situation is, most banks will assist you it’s just a matter of knowing how to ask. Use the hardship letter creator software which is my gift to ACA viewers. manda asks: Hi My husband has a bad credit rating run his own business and we would like to buy a house...can this credit rating be fixed in a year if we pay his debts off?
Dominique Grubisa: Yes, it is possible; however banks are very reluctant at the moment to deal with anyone who has a bad credit rating. Once you pay the debts off you can explain away the situation to the bank. Download the hardship letter creator software on my website because it may just be worth a try applying for a loan now and using the precedent letter relating to bad credit rating. There is an instructional video with the software to guide you through. Basically banks may overlook the bad credit rating if you give them a good enough explanation of the history of the matter – falling on your own sword.
kathym asks: Hi Dominique, I have been off work for nearly six years due to illness, and have had no real income since July last year. I have had to commence work again recently to keep up with the bills, and chose to start my own work from home business because I need the flexibility, and am unable to drive distances. I currently owe $3,800 on my credit card which I am about to start paying interest on. I am just able to keep up with my mortgage payments, which is currently around $1,400 per month. Until I get money into my business, I am either going to have to pay interest credit, or approach the bank with the hope of getting 3 months off my mortgage. What do you think would be the best way to go?
Dominique Grubisa: I don’t know enough about your situation to advise, however if you watch the videos on my blog and download the hardship letter creator software, then you will be able to make an informed decision on the matter. From what you’ve said, it sounds like you absolutely must be at my live event on 30th of May in Sydney or later at a capital city near you, because I will be dealing with the other half of the story which is not just keeping your creditors are bay, but fool proof ways to generate a cash flow from home.
njhm asks: I noticed that you helped that man reduce his mortgage interest rate from 9% to 5.04% was he is a fixed rate? We are fixed and are desperate to go back to variable as I am going on maternity leave at the end of the year.
Dominique Grubisa: No, he was on a variable rate with RAMS and Serza finance, but he did face huge break costs. There are ways around your problem, however I don’t know enough about your situation to fully advice. Melanie asks: Mortgage broker informed us that we would only face a $6k penalty to exit but now say they will charge us $37k to change from fixed to variable. Is there any way of getting around this?
Dominique Grubisa: Yes, it may be possible, but I would need to know more about your exact circumstances. vortex asks: I want to consolidate my credit cards.. but I have fallen behind in payments.. Is credit rating been affected..hence approval of debt consolidation affected??
Dominique Grubisa: You can check your credit rating online. There is an article on my blog on my website, which deals with credit ratings and a video, which will talk you through with your credit rating. Before forewarned is fore armed.
Pvvwp asks: Will the event also cover family, law? I noticed on the story she was willing to take on family law cases?
Dominique Grubisa: No, however it will deal with debt and financial matters in so far as they may relate to your family law case. If you come to the event, then I can talk to you in a break about your particular situation and hopefully point you in the right direction. I have written a idiot guide to family law for lay-people which has not yet been published, if you touch base with me on the event, I will forward you a copy.
CameronQ asks: My mortgage provider is vicious. They would rather take the house I think.
Dominique Grubisa: I think it’s just a matter of dealing with them in the right way, you catch more flies with honey than vinegar. Also, read the articles and videos on my blog and if you can, get to the live event which should set out everything in detail and give you a real plan that you can act on straight away.
alyn asks: Can you get loans refinanced that are 2 or 3 months behind in payments or do they all have to be up to date to refinance?
Dominique Grubisa: It depends upon the lender, if they are only a bit behind, they may not ask for more decent statements. It’s a matter of putting in an application and giving them the supporting documents and seeing if they are ask for more.
coach85 asks: Will we get a black mark against our names by using these letters? Will people have bad credit reports as result of this?
Dominique Grubisa: No, it’s perfectly ok to try and negotiate an arrangement. The letters ask that they take no further action against you whilst you are sticking to your arrangement. By using the letters and entering into an arrangement you are avoiding the potential of defaulting under a loan and getting black listed.
Sam asks: Do you know if there a code of practice for credit card providers who call numerous times a day just because of a late payment of less than $100?!
Dominique Grubisa: Absolutely. There is an article on my blog which deals with the legal obligation of credit card providers when they are chasing you. CameronQ asks: Where are you doing the live events, any in the SE Queensland area?
Dominique Grubisa: There will be an event in Brisbane and we will be dealing with getting out of debt by entering into arrangements with your creditors and then the second step will be how to generate a cash flow from nothing.
clavery57 asks: Is it better to deal with banks in person in regards to your credit cards and mortgage rather than speaking to them on the phone to get a better deal?
Dominique Grubisa: Yes definitely. There is an article about this on my blog, but basically as with everything, it’s about networking and you can definitely get a better deal when you meet someone face to face than when you are just another letter in their in tray.
Bala asks: If we get into financial hardship not having enough cashflow to meet the monthly repayments, what should we do (when we have a portfolio of 10 properties)?
Dominique Grubisa: You should contact your lenders and entry into an arrangement, use the hardship letter creator software and instructional videos which you can download for free from my website.
budgie asks: If you have to go bankrupt for non secured credit card debt, can you still try & keep house if you can pay mortgage, it is due to serious ill health?
Dominique Grubisa: You shouldn’t be looking at going bankrupt over unsecured debt. I’m not sure if they are chasing you or you are thinking of declaring yourself bankrupt. Bankruptcy is a last resort, and you are unsecured creditors will likely get nothing in a bankruptcy. They should be willing to do a deal with you in your circumstances and depending upon the fact, they may be legally obligated to give you a break. fergie asks: Am I liable for debt created by me on my mums credit cards. She is 85 and I have been keeping the payments up, but through the closure of our business I have let her help us. What happens to the debt if she passes away before I can pay it back?
Dominique Grubisa: You are not liable for debt in someone else’s name. If she passes away, then the debt passes with her and no one can peruse you. They may have a claim against her estate, however I would need more facts to discuss this further.
deejay_123 asks: Dominique do you do private consultations at your offices?

clavery57 asks: I have recently had to apply for a disability pension will this be taken into account when I contact my creditors to make smaller payments on what I owe?
Dominique Grubisa: Absolutely, under section 68 of the Consumer Credit Code, they are obligated to work with you and enter into a hardship arrangement with you. If they refuse to do this in the circumstances then you can apply to the consumer trader and tenancy tribunal for them to order your lender to enter into a varied loan arrangement with you. There are videos dealing with this on my blog and a precedent letter for you to copy in the hardship letter creator software. The videos that come with the software will also talk you through what to do in your situation.
hsvrosks88 asks: If you have debt problems because your business is slowing losing business is it alright to apply for a credit card to help you out of a few loans?
Dominique Grubisa: I’m not a financial advisor, however from a legal point of view there is no problem with this. It sounds like you need to increase your cash flow, and would benefit from attending one of my live events.
